SAVING
YOUR HOME FROM FORECLOSURE
If your home is about to go into foreclosure,
or you're so far behind in your mortgage payments that you can't
catch up, then a Chapter 13 is what you need to save your home.
A Chapter
13 is a bankruptcy that lasts from 3 years (36 mos.) to 5 years
(60 mos). During that time you pay one check, each month, to the
Bankruptcy Trustee.
That check includes your regular monthly payment and a small additional
amount of money which goes to catching up on your arrearages (ie:
the amount of money that you are behind on in paying the mortgage).
This is done by filing a "Plan" with your bankruptcy,
which shows the Court how long it will take for you to catch up,
and how much money you will be paying through them each month.
The mortgage company or bank, is forbidden by the Court from taking
your home, or taking any legal action against you during this time.
In fact, they can't even speak to you, or contact you. They can
only call your attorney or the Trustee.
Once
you're caught up, the bankruptcy ends and you go back to paying
your mortgage as you did before: on your own and, hopefully, on
time each month. The bank or mortgage company cannot discriminate
against you or take any action against you for having filed a bankruptcy.
